IP Australia protects my trademark


As a government entity, IP Australia registers words, designs, images and a range of products to give exclusive rights of use. IP Australia is a Federal government entity managed by the Australian government within Australia. The agency was founded in 1998 and is currently part of the Department of Industry, Innovation and Science.

IP Australia is enabled by government legislation to administer “intellectual property rights and legislation relating to patents, trade marks, registered designs and plant breeder’s rights in Australia.” Its URL (website) address is https://www.ipaustralia.gov.au/

As the IP Australia website says on its own homepage, “If you want to distinguish your goods, services (or both) from those of another business, you {might} need a trade mark. Find out what trade marks are and what’s involved in the application and management process…” at the following website page: https://www.ipaustralia.gov.au/trade-marks.

The IP Australia website goes on to say: “A trade mark is a way of identifying a unique product or service. It’s a form of brand protection which distinguishes between your products or services and those belonging to your competitors. A trade mark is not just ‘a logo’. It can be a letter, number, word, phrase, sound, smell, shape, logo, picture, movement, aspect of packaging, or a combination of these.”

In terms of business owners, a registered trade mark provides “… exclusive rights to use, license and sell the mark. It’s also a valuable marketing tool because the value of your trade mark increases with the success of your business.”

Why is this important? At a business meeting recently I was discussing my current business ventures and the kinds of work undertaken as part of my registered business with a trademark and an Australian Business Number (ABN).  Amongst the many traders, business owners and merchants I met that weekend, one merchant was surprised that my work involves a registered trademark.

For information and illumination, the following details are provided from the IP Australia website regarding my registered trademark which began on 08 August 2011. It is an active trademark and used on a regular basis for commercial activity.
